We use a few defined terms throughout these Terms and Conditions:
PLEASE REVIEW THESE TERMS BEFORE USING THE PLATFORM, AS THEY MAY HAVE CHANGED SINCE YOUR LAST VISIT. IF YOU DO NOT AGREE TO THESE TERMS, THEN DO NOT USE OUR PLATFORM. AISLE 3 IS A SHOPPER FOCUSED BUSINESS AND ALWAYS AIMS TO MEET THE NEEDS OF THE SHOPPER WITH A BEST-IN-CLASS EXPERIENCE.

How the site works
At aisle 3 our aim is remove the need for you, our Shopper, to open another tab or app to shop.
aisle 3 Shoppers create a profile that is linked to their preferred payment method. When you decide to buy a product we use these stored detailed to create a virtual payment card to enable us to complete the transaction on your behalf using our Cloud Basket® technology.
We aim to make our site the best and most trusted place for our Shoppers whilst also sharing the savings benefits of immediate cashback on every purchase. From time-to-time we may choose to incentivise Shoppers or provide rewards by adding funds directly to their wAll3t®.
When you decide to buy via aisle 3 we are effectively acting as an advertising agent for the Merchants by enabling them to complete orders and generate revenue. In return for this, the Merchants (and their tracking agencies) may pay us commission.
Where aisle 3 does not have a commercial agreement with a retailer, we may charge a service fee to facilitate our Cloud Basket® functionality.
From time to time, we may include links to external partners where Shoppers click-out to visit a Merchants site to complete their purchase – we define these as External Merchants.
Purchasing with a Native Merchants, using our Cloud Basket® on aisle 3, enables Shoppers to buy from multiple, unrelated merchants in one transaction without completing separate account logins or sign-ups and ensures a smart contract is assigned to your wAll3t® to record the transaction for future resale and commission earnings through our embedded marketplace.
Login Credentials; Social Platform.
In order to use our Platform, you will be required to register by providing certain information. We may ask you to complete a registration form and create a user name and password (“Login Credentials”). During any such registration, you are required to give truthful contact information (such as name and email address) in accordance with these Terms.
You are responsible for protecting your Login Credentials from unauthorized use, and you are responsible for all activity that occurs on your account (including without limitation financial obligations).
You agree to notify us immediately if you believe that your Login Credentials have been or may be used without your permission so that appropriate action can be taken. We are not responsible for losses or damage caused by your failure to safeguard your Login Credentials.
aisle 3 may enable you to connect to our Platform with your Facebook account, Google account, LinkedIn account or other third party social networking account information (“Social Platform”).
Site membership; usage; Sign up bonus
One account is allowed per person. If you have forgotten your login details and are unable to retrieve them via the system, do not create a new account, please contact us for assistance.
The legal owner of the email address used to sign up to the Site is deemed to be the account owner. Any Cashback earned by a third party using the account will be credited to the wAll3t® attached to the account as if you had made the transaction yourself.
When joining aisle 3 we will create a digital profile, against which all orders, payments, cashback and sign-up/marketing bonuses will be attributed. From time to time we may credit your wAll3t® with a wAll3t® Drop or sign-up bonus that can be used towards future purchases. Sign-up bonuses will expire after 30 days and we reserve the right to remove any additional credits without notice or reason.
By joining the site, you confirm you are over 18.
Managing your account
Be sure to keep your account up to date with your current email address to make sure you don’t miss out on any important information about your account.
You can manage your account within your account profile. Here you can subscribe to or unsubscribe from any emails we may send, although please note that you cannot unsubscribe to service emails which we deem to be essential in order to use the Site.
You agree to ensure your username on the Site is not offensive nor used in any way which may represent any trademarks or brand names. If we detect any usernames contravening this provision we shall contact you and request that you update this. Failure by you to respond within 14 days may result in your account being terminated and any cashback forfeited.
Termination of your account
You can cancel your membership at any time within your account settings and following instructions. If you prefer, you can email us at ‘firstname.lastname@example.org’.
In the event of fraudulent, abusive or other activity we determine to be unfair, we reserve the right to terminate your account.
You agree that any termination of your access to our Platform or any account you may have or portion thereof may be effected without prior notice, and you agree that aisle 3 shall not be liable to you or any third party for any such termination.
Please note that accounts may be disabled if they are deemed at our discretion to be dormant. In order to keep your account active, you are required to log into your account least once every 6 months.
The Platform may display listings, descriptions, and images of Merchant Products which are made available by third parties. We make no representations as to the completeness, accuracy, reliability, validity, or timeliness of such listings, descriptions, or images (including any features, specifications, and prices contained on the Platform). Such information and the availability of any Merchant Product are subject to change at any time without notice.
We have made every effort to accurately display the attributes of Merchant Products, including the applicable colours. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect actual product colour or finish. In addition, certain weights, measures, and similar descriptions are approximate and are for convenience only.
aisle 3 is not responsible for, and cannot guarantee the performance of, goods and services provided by third parties, including any Merchant, our advertisers, or other third parties to whose Platforms we link.
While our goal is to provide accurate information, product packaging and material may contain more and/or different information than that provided on the Platform, including the product description, country of origin, nutrition, ingredient, allergen, and other information. Always read labels, warnings, directions, and other information provided with the product before using the Merchant Product. For additional information about a Merchant Product, please contact the manufacturer. If you find a Merchant Product is not as described, your sole remedy is to return it in unused condition to the applicable Merchant, in accordance with aisle 3’s return policy. It is your responsibility to ascertain and obey all applicable local, state, federal, and foreign laws (including minimum age requirements) regarding the purchase, possession, and use of any Merchant Product.
Payments; Placing an Order.
Order Acceptance and Payment Processing. Payment processing for the Platform and any Merchant Product purchased through the Platform is provided by us or such third-party payment processor as we may utilize from time to time (“Payment Processor”). Our Payment Processer may collect or store your credit card information to enable seamless checkout for future purchases. By providing a credit card or other payment method accepted by aisle 3 and using the Platform, you represent and warrant that you are authorized to use the designated payment method. If the payment method you provide cannot be verified, is invalid or is otherwise not acceptable, your account may be suspended or cancelled. You must resolve any problem we or our Payment Processor encounter in order to proceed with your purchase or use of your account. Prior to accepting an order we may also request additional information from you. Verification of information may be required prior to the acknowledgment or completion of any purchase.
Cancelled Orders. If the item (s) you've ordered is out of stock at the time of packing your order, we need to cancel it. Please allow up to 5 working days for your refund, depending on your payment method. We reserve the right to refuse or cancel an order for any reason including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our Payment Processor. We will attempt to contact you if all or any portion of your order is cancelled or if additional information is required to accept your order.
In the event of cancellation we will refund your payment card and reimburse any funds spent from your wAll3t® back to your account for future purchases through our site. If your order included a service fee will we refund the amount, unless the remaining items exceed maximum cap applied to the total basket (£5).
By confirming your purchase at the end of the checkout process, you agree to accept and pay for the applicable Merchant Products, as well as all shipping and handling charges and applicable taxes.
After placing your order aisle 3 takes care of the order fulfilment using our Cloud Basket®. This is accomplished through financial instruments belonging to Aisl3 Ltd issued by Paynetics AD (via Paystratus Group Ltd, a Technical Provider of Paynetics AD) with company address at 76A James Bourchier Blvd, 1407 Sofia, Bulgaria, company registration number 131574695 and VAT BG131574695, pursuant to an e-money license issued by the Bulgarian National Bank No. 44/11.04.2016.
Shoppers receive a seamless purchasing experience, since aisle 3 manages the overall order fulfilment process.
Please allow 24 hours for order confirmation. We aim to process orders within 1-5 Working days however this time may vary depending on the Merchant.
aisle 3 reserves the right, including without prior notice, to limit the quantity of items purchased per person, per household, or per order for any reason. We will attempt to notify you should such limits be applied. aisle 3 also reserves the right, at our sole discretion, to prohibit sales to dealers or resellers. For purposes of these Terms, “reselling” will be defined as purchasing or intending to purchase any Merchant Product(s) through the Platform for the purpose of engaging in a commercial sale of the same Merchant Product(s) to a third party.
Pricing Information; Availability. aisle 3 cannot confirm the price or availability of a Merchant Product until after your order is placed. Pricing or availability errors may occur on the Platform or through Merchants. The receipt of an order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell a Merchant Product. aisle 3 reserves the right to cancel any orders containing pricing or availability errors, with no further obligations to you, even after your receipt of an order confirmation or shipping notice from aisle 3 or the applicable Vendor Retailer. aisle 3 may, at its discretion, either contact you for instructions or cancel your order and notify you of such cancellation. aisle 3 retains the right to complete the transaction and absorb any additional costs on your behalf, without notification.
In the event of cancellations, returns or refunds for orders containing multiple products we reserve the right to allocate the reimbursement of funds and cashback in line with the proportion of the original order.
Promotional Codes. Promotional codes are limited in nature and may expire or be discontinued with or without notice. Promotional codes are void where prohibited by law. Promotional codes may not be copied, sold, or otherwise transferred. They are not redeemable for cash and are subject to cancellation or change at any time for any reason without notice. We reserve the right to impose conditions on the offering of any promotional code.
Service Fees. Where aisle 3 does not have a commercial agreement with a retailer, we may charge a service fee to facilitate our Cloud Basket® functionality. Fees of 1.5% of each item will be applied at checkout, with maximum of £2 per item and £5 per basket. Service fees are refunded at the discretion of aisle 3.
Shipping and Delivery. Orders for Merchant Products will be fulfilled by the applicable Merchant. The Merchant will ship to an address designated by you, if applicable, so long as such address is complete and complies with the shipping restrictions contained on the Platform. Risk of loss and title for Merchant Products will be in accordance with the applicable Merchant’s shipping terms, and if none are provided, risk of loss and title for Merchant Products will pass to you upon delivery of the Merchant Products to the carrier by the Merchant. Delivery of Merchant Products to addresses outside the United Kingdom will be automatically cancelled. Some Merchant Products may have extended delivery times to specific regions of the UK. Estimated delivery times are determined based on standard delivery services when Merchant Products are purchased and the destination of the Merchant Products. For clarity, aisle 3 shall not have any liability with respect to fulfilment, loss and shipping of Merchant Products from the Vendor Retailer to you.
Earning Cashback. When you make a purchase via the Site with a Merchant, it is tracked using cookies and various other technologies which allow the retailer to identify that a purchase has been made, who made it and where it came from. Once the transaction has been acknowledged we will pass the cashback to your aisle 3 wAll3t® and automatically adjust the displayed pricing on our site. Cashback shall only be paid on transactions that meet the following criteria:
We do reserve the right to reclaim or adjust any Cashback payments in the event that any Cashback has been paid to you in error. This may include but not be limited to transactions where Cashback is not genuinely due to you or has been paid to you in error.
It is important to note that we do not hold money in your account similar to a bank and legal title to any cashback earnings are deposited to your aisle 3 wAll3t® and deducted from the price of future purchases through our site. Paid cashback my be subject to an expiry and we reserve the right to cancel any cashback balance without notice or reason.
For the avoidance of doubt and notwithstanding any other provision contained in these terms and conditions, you agree and acknowledge that in all circumstances the payment of Cashback to you is at our discretion and we may refuse to pay Cashback to you for any reason.
aisle 3 operates an embedded marketplace, allowing third party sellers and individuals to list and sell their products within our site and services. Seller’s products will be made available for sale on all of our Sites and mobile applications.
As a marketplace, aisle 3 provides the service and is the platform provider helping facilitate transactions of buying and selling products, aisle 3 is neither the buyer nor the seller of the seller's products. Accordingly, the contract formed at the completion of a sale for these third party products is solely between the buyer and seller.
aisle 3 acts as a commercial agent to conclude the sale on behalf of each buyer and seller involved in each transaction. Because sellers set prices, they may be different than retail value of the products sold on our Site.
Prices are set by the market and the seller, not by aisle 3, as such, we do not guarantee the sale of any product or operate as an auctioneer.
Smart Contracts; Purchases on aisle 3 are connected to a smart contract which is stored on the Blockchain as proof of original purchase. When an item is resold through aisle 3’s marketplace the Smart Contract is reassigned to the Buyer’s wAll3t® and becomes eligible for earned commission from future sales.
Marketplace Commission; aisle 3 reserves the right to charge the seller commission on marketplace sales. Commissions are distributed to the original retailer and previous owners in perpetuity provided an unbroken chain of ownership is recorded through the aisle 3 platform and corresponding smart contract.
Fees; aisle 3 charges processing fees to arrange delivery between the buyer and the seller. Deliveries may be tracked and used as proof of receipt in any disputes. aisle 3 reserves the right to change the fee structure and delivery expectations without notice.
Returns and Refunds; marketplace orders are not eligible for returns or refunds to the seller. In the event of faulty products buyers are requested to contact email@example.com to raise a dispute with our team. Buyers are able to relist unwanted purchases commission free within 14 days of receiving the order.
Links to Third Party Platforms
Purchases completed outside of aisle 3’s Cloud Basket® are not eligible for cashback and are not linked to a smart contract. Any customer queries, returns or refunds should be discussed with the External Merchant directly.
We operate systems on the Site to deter and limit any fraudulent use or abuse of the Site and reserve the right to apply any fraud prevention measures as we see fit.
We reserve the right to investigate any transactions that you make on the Site which may include the passing of your personal data to third parties who we work with in the provision of providing Cashback. If, at our sole discretion we deem that abuse or suspect any fraudulent use of any offer on the Site has occurred we reserve the right to terminate your account and you shall forfeit any earnings contained within.
Virus Protection; Malicious Activity
We do not warrant or guarantee that our site will be secure or free from bugs or viruses and shall not be held liable for any loss, damage or disruption you may suffer whilst using material derived from the Site.
You are responsible for configuring your information technology, computer programmes and platform to access our Site. You should use your own virus protection software.
You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.
You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site.
You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.
No Medical Advice
The Platform may contain Merchant Products regarding health care, medicine, nutrition and similar products. All such products should not substitute for, or be used instead of, a clinical or therapeutic relationship with a health care professional who is fully familiar with the specifics of your case.
Disclaimers; No Warranties
THE PLATFORM AND ANY CONTENT, MEDIA, SOFTWARE, PLATFORM OR APPLICATIONS MADE AVAILABLE IN CONJUNCTION WITH OR THROUGH THE PLATFORM ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, AISL3 LTD AND ITS AFFILIATES, CONTENT AUTHORS, LICENSORS, CONTRACTORS, EMPLOYEES, AGENTS, PARTNERS AND SUPPLIERS, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF SERVICEABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. Indemnification; Hold Harmless.
You agree to indemnify and hold AISL3 LTD, and its affiliates, suppliers and partners, harmless from any claims, losses, damages, liabilities, including attorneys’ fees, arising out of your use or misuse of our Platform, violation of these Terms, violation of the rights of any other person or entity, or any breach of the representations, warranties and covenants in these Terms. aisle 3 reserves the right, at our own expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us and you agree to cooperate with our defence of these claims.
Providers of Third-Party Services.
You hereby acknowledge and agree that all of our partners, licensors, suppliers or other third parties: (i) may not be parties to these Terms; (ii) have no obligation whatsoever to furnish any maintenance or support with respect to aisle 3; (iii) are not responsible for addressing claims by you or any third party relating to our Platform, including without limitation any product liability claims, claims under consumer protection laws or claims under any other law, rule or regulation; and (iv) have no responsibility to investigate, defend, settle or discharge any claim that our Platform or use thereof infringes any third party intellectual property rights.
Limitation of Liability and Damages.
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL AISL3 LTD OR ITS AFFILIATES, CONTENT AUTHORS, LICENSORS, CONTRACTORS, EMPLOYEES, AGENTS OR THIRD PARTY PARTNERS OR SUPPLIERS, BE LIABLE TO YOU FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT RESULT FROM YOUR USE OR THE INABILITY TO USE THE AISL3 LTD MATERIALS ON THE PLATFORM, THE PLATFORM THEMSELVES, OR ANY OTHER INTERACTIONS WITH AISL3 LTD, EVEN IF AISL3 LTD OR A AISL3 LTD AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, AISL3 LTD’s LIABILITY WILL BE LIMITED TO THE EXTENT PERMITTED BY LAW.IN NO EVENT SHALL AISL3 LTD OR ITS AFFILIATES, CONTENT AUTHORS, LICENSORS, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD PARTY PARTNERS OR SUPPLIERS’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM (WHETHER IN CONTRACT, TORT, WARRANTY OR OTHERWISE) EXCEED FIVE GBP (£5).THESE LIMITATIONS SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF ANY PRODUCTS OR PLATFORM, INCLUDING VENDOR PRODUCTS, SOLD OR PROVIDED TO YOU BY THIRD PARTIES, INCLUDING VENDOR RETAILERS, OTHER THAN AISL3 LTD AND RECEIVED BY YOU THROUGH OR ADVERTISED ON THE PLATFORM OR RECEIVED BY YOU THROUGH ANY LINKS PROVIDED ON THE PLATFORM.
YOU SPECIFICALLY ACKNOWLEDGE AND AGREE THAT, TO THE FULLEST EXTENT PROVIDED BY APPLICABLE LAW, AISL3 LTD WILL NOT BE LIABLE FOR ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY VENDOR RETAILER OR OTHER USER OF THE PLATFORM.
Use of our Platform; Rules about linking to our Site
As a condition of your use of our Platform, you shall not use our Platform for any purpose that is unlawful or prohibited by these Terms. Access to the aisle 3 Content and our Platform from territories where their contents are illegal is strictly prohibited. You are responsible for complying with all local rules, laws, and regulations including, without limitation, rules about intellectual property rights, the internet, technology, data, email or privacy.
You may link to our Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You may not use our Platform in any manner that in our sole discretion could damage, disable, overburden or impair it or interfere with any other party’s use of our Platform. You may not intentionally interfere with or damage the operation of our Platform or any User’s enjoyment of it, by any means, including uploading or otherwise disseminating viruses, worms or other malicious code. You may not remove, circumvent, disable, damage or otherwise interfere with any security-related features of our Platform, features that prevent or restrict the use or copying of any content accessible through our Platform or features that enforce limitations on the use of our Platform. You may not attempt to gain unauthorized access to our Platform, or any part of them, other accounts, computer systems or networks connected to our Platform, or any part of them, through hacking, password mining or any other means or interfere or attempt to interfere with the proper working of our Platform or any activities conducted through our Platform. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through our Platform. You agree neither to modify our Platform in any manner or form, nor to use modified versions of our Platform, including (without limitation) for the purpose of obtaining unauthorized access to our Platform.
Our Platform may contain robot exclusion headers. You agree that you shall not use any robot, spider, scraper, crawler or other automated means to access our Platform for any purpose without our express written permission or bypass our robot exclusion headers or other measures we may use to prevent or restrict access to our Platform.
You may not use framing techniques to enclose any trademark, logo or other aisle 3 Content without our express written consent. You may not use any meta tags or any other “hidden text” utilizing aisle 3’s name or trademarks without our express written consent.
You may not deep-link to our Platform and we may promptly remove any links that aisle 3 finds objectionable in its sole discretion. You may not use any aisle 3 logos, graphics or trademarks as part of the link without our express written consent.
You may not send junk mail to other users, including, but not limited to unsolicited advertising, promotional materials or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests and petitions for signatures.
If you wish to link to or make any use of content on our site other than that set out above, please contact firstname.lastname@example.org
We reserve the right to withdraw linking permission without notice.
Our trademarks are registered
"aisle 3" is a UK registered trade mark of AISL3 LIMITED. You are not permitted to use it without our approval. We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
